So I was wondering if anybody could help me on this issue. My boyfriend is currently stationed in AZ for his AIT classes. He was supposed to have been able to leave for the fourth of July weekend but it was denied due to a medical profile. As far as I know his profile ended on Sunday and he returned to regular PT and soldier life and they tell him he is still healthy enough for deployment in December. Is there anyway he could appeal the decision or get it changed in any way?

Leave/pass are up to the Commander, he can be denied leave/pass.

As far as "you" know his profile ended, but there is also recovery time, and why would a profile prevent him from going on leave? Where was he trying to go for the 4th?

Well he has ARDS, plus he was in the hospital and sick call this past week. It was denied for AR-171 UCMJ. However if he is healthy enough to return to normal routine after only a few days and they deem him healthy enough in his present condition to make a fair call about deployment isn't there some way he can get it changed. He was supposed to fly to VA and stay til Monday.

You get laeve in AIT? Now for exodus I know you get leave but for the 4th of July?? Is he re-classing?? Denied due to medical.. humm fishy, it there more to this?? Recovery time yes of course, is there a failed test, failed PT before the profile? To me something is missing, but that's just me.

Denied leave, don't ever think I have seen this, I know it can happen and almost saw it happen.

ohhh ohhhh Where was he going and how was he getting there. If driving maybe the Commander says no for safety?

The average Shepard can run 35mph, can you??

Oh so he is not getting denied b/c of health, he is getting UCMJ, so he got in trouble for something he did. I dont see ART 171 under the UCMJ, but there is definately more to this story than what you are telling us, or what you been told...

I'm not sure if he got to take his PT test...I think he may have been in sick call or something I'll ask him about it tonight. He was flying to VA. And what do you mean by "fishy"?

That's what I was afraid of TransAm...he acted really weird when I told him I would look into it...he got really pissed off and grouchy towards me...and started to rant...but he has been under alot of stress lately so i figure that's what it is...and your right it doesn't sound like he's giving me the whole story...

Ok I finally found it. There are only 146 Articles for the UCMJ. Ok 158 see below.

How many articles are there in the UCMJ?
There are 146 Articles in the UCMJ. There are also sub-articles which total 12, nested within the UCMJ such as the following example: Article 106 deals with "Spies", but Article 106a Deals with "Espionage". It would be more accurate to state a total of 158 Articles in the UCMJ (The 146 Articles + 12 Sub-articles = 158)

Now what in the heck is an Art 171 UCMJ?

Ok fishy = wrong choice of words. Random like I said I have never seen leave denied for Medical, and now there seems to be more to the story. UCMJ is not fun!!!

I got out of AIT at Fort Huachuca about 9 months ago. I know it was very difficult for us to get leave approved (a pass really...) if we were going out of state. It's still a training evironment so you don't have as much freedom as you do later. It really does just depend on your command. The commander has the final say, but he/she will (more than likely if its a good commander) listen to the first sergeant too.

Basically, if he missed a PT test, he's behind on anything else, or especially if he's gotten into any kind of trouble, that's enough reason for them to say no. And it sounds like there's something else going on because he didn't want you "looking into it."

Good luck, though.
