I have been receiving BAH Diff for the last two years while stationed in Germany. I paid child support to my ex wife, who was AD Air Force at the time.
I was married on 19 January of this year(still in Germany), but continued to reside in the barracks since my wife(also AD Army) was due to PCS in less than a month and I would not be PCS'ing until July. When I went to outprocess Germany, I found out that my marital status had never been changed in Finance, and was informed that I would have to pay back all of the BAH Diff that I had received since my marriage date. BUT, my finance office told me to let my gaining finance office correct the error when I went to inprocess there. My finance office in Germany could not explain to me exactly why this was to my satisfaction.
My wife is stationed in Miami, with her son, and receives full BAH w/dep. I will be arriving at Fort Gordon on Monday, and would like to know if I can expect to pay $1200 back to the Army... but most importantly WHY. I've tried reading the JTFR, but can't really find an answer in all of that.
Also, will I be allowed to live in the barracks at Gordon?
Any help, advice, or answers are greatly appreciated!
Correct. I'm in the process of adopting, but nothing is official as of yet. I have two kids from a previous marriage that I pay child support for. My ex wife is no longer in the military either.
Ok, here is your answer. IAW with JFTR chapter 10, Station Allowances. Service member married to another Service member are consider single to BAH entitlements. Meaning if you are married to another soldier, residing in barracks, paying child support you still entitle to BAH diff. Making you paying back the money only occurs if you moved to Govt housing in Germany, and since you didnt you will be ok. Now every post have different rules for barracks so depending on your rank you might get a barracks room or not. For example FT Campbell if you are married and you spouse is not at FT Campbell, you have to move out of the barracks. So you need to find out with FT Gordon. Hope this answer your question.
