Only getting 4 years of bonus for 5 year enlistment

I reclassed last year and just arrived at my next duty station. I started the process to reenlist under the BEAR message I extended under in March 2012. The part I am confused about is this. The retention NCO broke down my time in service by contract. My initial enlistment, my first reenlistment, a 3 month extension I signed in 2009, and then my BEAR extension I signed last year. He said that I have just started serving the 3 month month extension I signed in 2009, and because of that, If I reenlist for five years, I will only get 4 years of bonus, if I reenlist for six years, I will only get five years of bonus, etc. I did not receive a bonus for that 3 month extension in 2009. I have six years TIS now.

Army isn't going to pay you for time that you already owe the Army.

When you reenlist, the time remaining on your current contract is "forgiven" and replaced by the new contract. So it has nothing to do with "owing" the Army anything. A new contract always replaces your previous obligation. That has always been my understanding and that's how it worked the last time I reenlisted in 2009. My question is why would the three month extension I did in 2009 affect the bonus I get for reenlisting now.

So you still owe the army a year and you reenlist for 5 years. Which means technically your only adding 4 years to your ets date. Why should you get paid for an extra year you already owe the Army? Its simple math your only adding 4 years so your only getting paid for 4 years. Where and in what regulation does it state that you are "forgiven" time you owe the Army? Did your career counselor not explain it to you? Or did you just not like the answer you were given?

Stand by Im asking the experts might be a minute but ill provide you some regulatory guidance on this.

When you reenlist your contract starts that day, there is no "owe" anything to the Army, so if you have one year left and you reenlist for 6, your six years start that day. Yes you can argue that you still had that other year so you are only adding 5 years, but it does not mean you "owe" the Army that year.

10. Soldiers who participate in the BEAR Program and subsequently enter their reenlistment window are authorized to reenlist for any option in which otherwise qualified however the previously obligated service WILL NOT be forgiven. Soldiers who desire the Army Training Reenlistment Option (E-3) must have held the BEAR MOS for a minimum of 12 months from date of graduation or meet the SRR IAW AR 614-200. This is from the latest BEAR program milper message. SO in essence you still "OWE" the Army whatever time you still have on your current enlistment.

I am copying right off my BEAR contract, Paragraph 4, sub-paragraph C:

"An SRB is paid only for "additonal obligated service" and any time remaining on the extension of enlistment that is executed upon entrance into the BEAR program is considered "previously obligated service". However, the Army will forgive up to 24 months "previously obligated service" provided the soldier reenlists (Option E-1 only) within 90 days after completion of training.

Bold added by me.

So yes, the Army will 'waive' off up to 24 months of your extension and will, in fact pay you for time you already owe. Meaning, if you reenlist for 3 years, your old ETS date will go away and your new one will be 3 years from the date you reenlist, NOT 3 years from your old ETS date like usual. My .02

ArmyReenlistment.com Reenlistment bonuses are paid on 'Additional Obligated Service' or AOS...additional obligated service is any active service commitment beyond an existing contractual service agreement. This includes enlistments, reenlistments, and extensions of enlistments/reenlistments. (AR 601-280, para 5-7)

Additionally (AR 601-280, para 5-7), An SRB (selective reenlistment bonus) is paid only for 'additional obligated service' and any time remaining on the extension of enlistment that is executed upon entrance into the BEAR Program is considered 'previously obligated service.' An SRB will not be paid for any un-served time remaining on the extension of enlistment at the time of reenlistment following successful completion of retraining into the new PMOS. Soldiers participating in the BEAR Program may be forgiven up to 24 months of 'previously obligated extended service' provided they reenlist (Option E-1 only) within 90 days after completion of training Implementing instructions will be announced via RETAIN and/or MILPER messages.

You'll need to see your Career Counselor for an accurate computation...but I'm sure you already received that.

JOSHFREE has it right... simpler terms follow though.

Example:
You had 10 months left
You reenlist for 5 years (60 months)

ETS:
Will be 60 months from the date you sign the contract (under normal enlistment this is true primairly because you cant re-enlist with more than 12 months out, and under BEAR you can get up to 24 months "waived" as posted by Dar)

Bonus:
Your SRB will be calculated using the additional time/months incured as the multiplier. I.e you only get paid for the NEW months on the contract. The reason this is done is becuase you were elidgible for a bonus on your first contract, and the Army will not double bonus you for this time.

60 Month (5yr) re-up - 10 months still owed = 50 months elidgible for a bonus.

BLUF:
When talking about "waiving" time on the contract, that has to do with ETS, when talking about BONUS, you deal with added months.
