My father recently passed away and he was the person on my family care plan who I had put in place to care for my children in case of deployments. My CO just counseled me last week about my FCP and I told him I wanted to receive a chapter 5-8 to get out. I have researched this chapter up and down and several different installation JAG websites state that the SM can waive the 30 day waiting process if they submit a waiver stating the SM does not have a valid FCP now or will have one in the future. I stated this in my counseling that I would like to request this waiver. However, even though requesting a waiver is stated in these JAG "Leaders handbooks", I can not find anything about it in any regulation (AR 600-20 or AR 635-200). My CO is being very understanding of my situation and told me if I find something in a regulation somewhere he will in fact grant me a waiver. I have searched but can not find anything...Can anyone help out or have had a similiar experience they can share?
