ETS from RC was Jan 2008, Demob'd June 2008.
Now, as of the demob station, I did not have an approval letter for RC/AC yet. So, I had to take all that retroactive Admin leave from previous deployments, and the leave from this one, and sell some. So that means that the discharge date on my DD214 is 19 September. (yes, lots of leave)
Now, I have an approval letter for RC/AC. But am being told by the recruiter assigned to me that I can't sign a new contract until the day AFTER my leave ends. Then will have some PTDY to actually move.
Since I have school aged kids, moving now (summer) would of course be better than the end of Sept. Not to mention, if i had pcs orders I could take my time and house hunt, etc.
The question is, 1. is this right? 2. Is there some way to fix it... like a dd215?
And how do people in this program sign their new contracts while still in theatre? wouldn't still being on AD with their unit be the same thing as still being on AD but on Leave?

Any help would be greatly appreciated. Or, since the duty station is already on the approval letter, is there a way to start moving now (i know it's a risk), and get reimbursed later after i get pcs orders?

KVR, i did this program, and this is what I can tell you.

(1)You sign the contract for Regular Army the day after your terminal Leave ends. This is set up so there is no break in service, and DOR will stay the same. IE, my terminal leave ended August 21st 2007, I signed my New contract aug 22nd, 2007...thus no break in service on the active duty side.

(2) People do not and can not sign the contract in Iraq/Afghan... You have to be off Actived Reserve Status in order to contract, ie When you go into Meps to sign the Preliminary Contract, it is a prior service/reserve contract.

(3) As for PCS orders, I am single, and was given the option to drive to Ft Lewis, or to just take the plane. I didn't get offical orders until I signed the offical contract on the 22nd, because until then I was not authorized a legal PCS. When I got to lewis, all my paperwork then stated I was authorized PCS.

Any other questions pm me and I will give u my contact info. I have helped 9 or 10 other guys with this program and no i don't get any money for the smart or s-rap program

According to the info in the approval letter, PCS orders will be issued via AKO within 24 hours after the contract is signed.
Thanks for the info. So I guess now I just need to figure out if I can sell a little more leave, hence changing the date on the dd 214. Or, move now and get reimbursed for it later after the PCS orders come......doesn't seem very likely that that would be possible, to me anyway. But I suppose if the dates on your receipts were after the date on the PCS orders you would be in good shape.
I think there just has to be a more "official" way to go about it!
