I'm getting chaptered on a 5-17, other physical or mental health disorder, specifically for an adjustment disorder. Now I'm not trying to be chaptered, even though it's an honorable discharge. I signed up to serve and thats what i want to do. Now, there's only one major discrepancy in the paperwork. The company commander's recommendation says I was "given ample time to try and rehabilitate" meanwhile, the next page says "Description of rehabilitation attempts, if applicable: NONE" which is true, nothing was done to change the situation in which i was facing. Can I use that as a starting point in defense?

my friend died last year in my barracks. didnt work out well in my head. took a good 9 months to get over it, but i have. I never got a second medical opinion though. Actually it turns out the doctor signed off on July 31st reaffirming his original decision. the issue with that is I never saw him since april. Being a medic, i know that this would be known as an ethics violation. Well thats just 1 of 3 major faults my JA found, but it seems that I don't know where to go with this information because I don't know what my counsel can do. I'm really stuck, but I really want to stay in. MY COMMAND WON'T BUDGE REGARDLESS OF WHAT HAPPENS...

Two things,
First, ask the folks up at JAG, they are there for you. They will tell you legally what you can do, and that is a lot more than anyone here can tell you (unless a lawyer is on the site).
Second, if the death of a friend has shaken you up that much, then this is probably not the correct career for you. I don't care what you do, our job is to go into harms way and stil be able to function regardless of what happens.
I'm not trying to criticise you for any issues you had in dealing with your friends death. We all deal with tramatic issues in different ways. I'm just saying you and those you serve with may be better served if you are not put into that position again. Remember, they are counting on you to be able to function and be at 100%, lives depend on it.

fully understood, sergeant, and not to argue with you, because this really isnt a sensible place, but my whole point is it did shake me up for a little bit, but ive grown to deal with it, and got passed it, and i think ive learned from it. meanwhile my entire company has very few people who have deployed, even amongst our NCOs, and I dont think it seems fair that Im being put out because of something that happened in garrison, where, correct me if im wrong, but it should be safe. But i guess soldiers killing soldiers is ok, so long as no one's feelings get hurt, then chapters are in order. This unit has been a sham, but I dont think the army as a whole is, and thats why id rather stay in. I just wish i would get even a chance.
