Ok if I could have alittle help. I am stoplossed and had a ETS date of 02 OCT 09 when I went to the board(02JUNE08) and met the requirement of 12 months left in the army. So on 28JUNE08 the army decided to change my stoplossed ETS date to 02JUNE09 and promotion date would be 01JULY08.. Now I don't meet the requirement by 28days. Is there any thing I can do about that besides reenlist/extend?
I think you and I are in the same unit brother. They are SCREWING us stop loss folks!! I too have the same problem. I was sent to the E-6 board in June 08, made points for AUG 08. They changed my stop loss ETS date (arbitrarily) from 02 OCT 2009 to 02 JUN 2009 sometime during the month of June 08. From what I know, stop loss personnel are supposed to be given a minimum of 90 days post redeployment to clear and ETS. We are scheduled to redeploy late May of 2009 (I checked with HRC). So that gives me a week to clear?? Thats not right, correct? Sounds fishy to me! Problem # 2 is this... NOW they are saying I cannot extend to meet SSR! They are saying I have to REENLIST! Here's why (And I have proof in an email from our BDE SMAJ) They said the I dont meet the 13 month ext requirement because they base extension/reenlistment off of the SM's CONTRACT ETS date!! Is that possible? If so, that means I need to extend for 16 months (which by reg. I cannot do) So they say I need to reenlist for 2 years min.
I thought once a person is stop loss their contract ETS is no longer valid. Im about to go to IG, any help would be MUCH appreciated. I think there are ALOT of soldiers in our BDE in the same situation, and I feel that they are just trying to increase retention numbers. Sorry for the long rant.

Its just hard for me to understand how this is happening. I always thought the number ONE job of an NCO is taking care of his/her soldiers. I cant figure out why people "higher" up are letting this fly. I know the Army has quotas, but my lord, has the Army resorted to this as their new retention program?
I just need to figure out if my BDE is allowed to arbitrarily change our ETS to "improve" their retention numbers. And If not, how can I prove thats what they did.
I have the MILPER MSG (04-169) stating that they must give me 90 days post redeployment once the stop loss is in effect. The only time they can change the date is if the first LTC or above in my command allows me to leave earlier ONCE WE HAVE REDEPLOYED. I have tried searching for this on the AKO MILPER site, It gives me an error code when I try to open it. Its a bit old, so I'm not sure if there is an updated version. Maybe someone can chime in on that.
Anyway, thats about it. Im trying to become more knowledgeable about the situation. Any tips will help.

Ok, I did some more research. I just may need some clarification on these regs.
AR 601-280 states in table 4-1 that I CAN extend for no longer than 13 months to meet SSR for SSG.
Now, in 4-9 (a) It states: that "Soldiers within the reenlistment eligibility window and otherwise qualified, must reenlist to meet the SRR, they may not extend". I BELIEVE that is saying "unless table 4-1 says you can extend for a given situation, you must reenlist". Am I deciphering that correct?
Ok, the next reg I came across is 4-7 (a) This is having to do with from which ETS they validate my extension from: "a. Extensions are posted to military personnel records immediately. However, the actual effective date of the extension, is the date following the soldier’s current current ETS."
So, they cannot use my "contracted" ETS like they are saying they can,according to this reg, correct? Sorry for being a post junkie. My platoon Sergeant is allowing me time to figure this out (in a combat zone)I'm just trying to resolve this as quickly as possible. Thanks
From what I gather from par 4-9 it states that if you are within your re-up window you cannot extend, you must re-up to meet SRR.
Yeah I got a 95 Trans Am, bought after I came back from Korea, I had lots of work to just get it to normal, got more work needed, its my daily driver.
I had to fix the AC, then it had no speakers, so I got a new headunit(with ipod capability), new speakers all around, a sub on that empty space on the trunk (opposite side of the spare tire), then i wrecked it so I thought I'd get a whole body paint job since all the paint was faded, and got a WS6 Ram Air hood, just gotta get the Airbox installed now.
Yeah I love my Trans Am man, I always wanted one, but maybe after a while I'll sell it and get a newer one, I dont know.

No, if you are in your 24-month reenlistment window, you must re-enlist or lose whatever is imposing a service remaining requirement on you, regardless of your ability to extend or not. (We just covered this topic in Retention Team Training today).

AR will you please clarify, but I am pretty sure that getting promoted to SSG is an exception to the rule and you can extend. Table 4-1 clearly states that you can extend "before promotion regardless of Reenlistment eligibility window".
An extension for promotion to SSG is one of the few exceptions that can be accomplished in the 24-month reenlistment window.
Clarified with HRC that the extension will be dated from the contractual ETS and not the stop loss ETS.
Just a side note, but Soldiers who are extending past their contractual ETS due to Stop Loss will have the following statement placed in the remarks section of the DA Form 1695, Oath of Extension of Enlistment: "SOLDIER RETAINED ON ACTIVE DUTY FROM (DAY AFTER CONTRACTUAL ETS) FOR AN ADDITIONAL "XX" MONTHS FOR THE CONVENIENCE OF THE GOVERNMENT UNDER THE PROVISIONS OF TITLE 10 USC 12305 (STOP LOSS)". This is to officially account for contractual time.
Off topic but, I have 2002 TransAm, last of the breed. It's not a firehawk but it will do. It's fast but only on straight aways, I normally drive my Tahoe to work, got bored with the Trans Am. My next car will probabley be a New Mazda Rx8, better for corners. I never thought to tell you, even though I've read 100's of your posts :].
