Hello. I am an E-5 that has been OJTing with CID for 5 months. I submitted my packet and got approved, but the final step was to get a Branch Release. My Branch said that they would not release me. So I did some research and found that AR 614-200, paragraph 3-18(h) states that regardless of the Soldier's IN/OUT Calls the Soldier can reclass into several different MOS's and 31D is one of them. Branch didn't seem to care that the AR and MILPER Message 08-057 stated the same thing. I have gotten my CSM involved along with my Battalion Commander. My branch still says that they can not release me due to the fact that the MOS is at 85% strength. The problem I am having is that they are only short in E-4 and below not E-5. I do not understand how Branch can do this. To top it off I had a car accident last April and went through PT for a year. My doctor is writing a profile for me limiting my allowed weight to pick/up and pull/push. This will pretty much disqualify me from my current MOS, but still keeps me in the limitations of 31D. I don't feel that I should have to go through an MMRB just to get a branch release. Also, 31D is not an MOS that you can just reclass into. Is there anything that can be done as to get a branch release without going through a MMB? I really would like someone to help or give me something to rub in their face for my release. If anyone could help that would be great.

If your Battalion Command / Battalion Sergeant Major cannot grease the skids with your branch, you're only recourse may be the MMRB. If this get you the MOS, what's the big deal?
The problem with the MMRB is that I can't reclass into 31D because it is an application only MOS. How is it possible for Branch to deny my release even though they are not short Skill Level 20's?
I'm sorry for the misunderstanding. My current MOS is 15J20 and is critically short for Skill level 10 not Skill Level 20. As for the Medical Reclass into 31D that is not possible due to it being an Application only MOS. I feel that Branch should release me and am looking for some guidance or something to help me out.
Right you have to have a PULHES of 222221 to be qualified to become a 31D. However, 31D is an MOS that is selected by Application only. And since my branch will not release me they can not give me an acceptance letter. They can only provide me with word that my packet is approved. I guess the whole point I'm trying to make is that it should not have to come to a MMRB if my branch manager would be reasonable and see that I am not physically able to do my job in regards to my profile, and just release me.
SGT BOD, the MMRB will get you released from the AVN branch. Once you get the Official MMRB Board results you will talk with your Career Counselor, Let them know that you have been accepted to CID for reclass. The Reclassification branch will work with you. Your branch manager will have NO control in this action.

Thank you acrftgrunt. I just was trying to find a way around the MMRB because that is a 4 month process not to include the time it takes for the docs to refer me to the MMRB, and I could have had a class date for 27 May 08, if only my Branch would've released me. Now the earliest class date is July. Right now, I have a 2 and for me to be referred to the MMRB I have to have a 3 in my PUHLES. I have different angles working now, but if all else fails this will have to be my last resort. Hopefully the powers that be can convince my Branch for my release. I feel like a d*** hostage or something. Thanks again acrftgrunt!
