Here's the situation. I'm an E4, and today my PSG told me I am going to have no choice but to sign for a truck. BII for a LHS and everything with it. The key control system is damn garbage and I don't trust other people if they lose things. I asked what will happen if I don't sign, and she said I have no choice. That pissed me off, and I called it a day to find a reg. that will help me out. I need some help here, something that will say yes or no. Thanks guys
Article 92 -Failure to obey order or regulation If your PSG is telling you to sign for this stuff and you don't. But don't even sweat it because if something does come up missing and it is not fault of your own and you can prove that you will not have to pay a thing(I am in supply) so I deal with that situation all the time with BII.
I was just wondering if there was an actual reg saying i had to sign for it. i do understand the order violation. i've been in for 7 years, and just never heard of soldiers signing for equipment that they didn't have total control over for the most part.
Normally they would not. But different places different things I guess. Here where I am at it happens all the time. Use the DA form 2062 to your advantage. List all of the shortages. Also when some one uses this piece of equipment make sure they sign the 2062 with all of the BII on it.
Don't sweat it, my friend!!! .... I'm a 92Y and I see this stuff all the time. Go ahead and sign for the truck. Now, it sounds to me tht perhaps your PSG may of signed for it originately. Before you sign your 2062 though, you're want to mark any COEI,BII as well as AAL that maybe missing. Your supply people can help you with the TM's an can help with a shortage annex. What I would of done, I would of gotten a Memorandum of record stamped off by JAG that outlines what was said and tht you were forced to sign for the truck. That way if it were to go to a 15-6. That may help. Also, don't worry so much for others using it. If that PSG had signed for that truck originately or if somone else in a supervisory position take procession of it and something happens to it. He'll or they could end up paying for it, not you. Under AR 735-5, ch 2-8 for supervisory responsibility. It's says:
"Supervisory responsibility. The obligation of a supervisor to ensure all Government property issued to, or used by his or her subordinates is properly used and cared for, and that proper custody, safekeeping, and disposition are provided. It is inherent in all supervisory positions, is not contingent upon signed receipts or responsibility statements and cannot be delegated. It arises because of assignment to a specific position and includes-— (a) Providing proper guidance and direction. (b) Enforcing all security, safety, and accounting requirements. (c) Maintaining a supervisory climate that will facilitate and ensure the proper care and use of Government property."
