I just recently had my NCOER sent up without being given the opportunity to sit down with my rater and talk about it( I left for school for 8 weeks). In fact the rater did not do the initial counseling, it was the sr rater. Is that legal?
The last NCOER I had, my NCOIC came to my office to talk about it because he was my rater.
As a rater, you are not required to talk abou the bullets. They should not be surprised by the comments if they counseling is done. I am quite sure you signed the NCOER, thus verifying the admin data was correct, and I would consider the counseling part of that.
The Senior Rater has comments as well, and another portion of their job is to ensure the Rater is doing the counselfing.
There is nothing illegal about this. When I think of legalities, I think of criminal! However, if you think you were wronged, the Army has an appeals process. Familiarize yourself in that matter and go forward.

I agree with your statement, but as the ratee, I do have a right to look at the finished product. I only received a initial counseling. As a backup, what is the regulation that covers filing an appeal based on bogus information, ie counseling dates? I am a firm believer that I am "Blessed and highly favored by the most high God." So when I do see this NCOER, I won't loose any sleep over it.
