legal action over reselling pet

I purchased a puppy from a woman (soldiers wife) in Germany that was breeding in her home a while back.When I went to register him she told me not to say I bought the dog so she wouldn't get in trouble for breeding. She had me sign a contract she made up stating that she would take legal action against me if I tried to resell the pup. She states I have to give the dog back to her if I no longer want him so she can re-sell him making double the profit. She also stated that she would take the dog away from whoever bought it from us. I don't know how legally binding the contract is considering legal wasn't involved.. can she take any legal action against me? or is this extortion?? someone help!

That sounds really shady. It sounds like she is an illegal breeder and she needs to be exposed.

Have you taken this dog to the vet? The fact that she wants to have one degree of separation from the dogs and that she doesn't want you to tell that she is the breeder is a huge red flag.

If something is wrong with that puppy (or anyone other puppy she is selling) you will probably have to say where you got it.

Talk to JAG about that. She needs to be shut down.
Well, first let me say that I'm not a fan of backyard breeders, which is what she sounds like. When you buy from a shady breeder, no one wins.

However, requesting that you don't sell/rehome the dog is actually very common w/ most breeders and you'll find it in pretty much any contract. It's done for a few reasons, one being that if there's a problem with the dog, it doesn't go into circulation to possibly be bred and continue the problem.

And yes, if you do pass the dog along, she can take legal action and take the dog back from whoever you gave it to. Legal doesn't need to be involved, you signed a contract.

Why are you asking? Are you considering getting rid of the dog?

If the breeding or sale was illegal, then the contract is unenforceable.

No. It simply has not been executed properly--the consideration (the dog) is not what was specified in the contract. However, since you accepted the male dog, it could be argued that you implicitly accepted the change in consideration.
